Official Rules

OFFICIAL RULES AND REGULATIONS

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING. ODDS OF WINNING WILL DEPEND ON THE TOTAL NUMBER OF ENTRIES RECEIVED. VOID WHERE PROHIBITED BY LAW.

THESE OFFICIAL RULES ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. THIS CONTRACT INCLUDES INDEMNITIES TO THE SPONSOR FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES. 

1. SPONSOR: 2428392, Inc. dba FYE, Interactive Marketing Department, 38 Corporate Circle, Albany, NY 12203 (“Sponsor”), is solely responsible for all aspects of this sweepstakes (“Sweepstakes”). 

2. ENTRY: Beginning at 1:00PM, 2/05/2024 and ending at 11:59 PM, 2/13/2024 (“Entry Period”), you may enter by completing the following :

During the period above, participants may enter by following the steps outlined in the Instagram post. Winners will be chosen at random on 2/14/2024

For purposes of these Official Rules (“Rules”), all times and days are Eastern Time and “Entry” shall mean and refer to each Internet Entry and Mail Entry.

3. LIMITATIONS: Each response must be received during the Entry Period. No more than one (1) Entry per person/household/Account per question is permitted during the Entry Period (regardless of method of Entry or whether one person has more than one Account). In event of a dispute regarding the identity of the person submitting an Internet Entry, the Entry will be deemed to be submitted by the person in whose name the Account is registered. Entries by any method other than set forth above in Section 2 are void. Any use of automated or programmed methods of effecting Entry is prohibited. Open only to persons who upon entering are age of majority (as defined by their jurisdiction of primary residence) and who are legal residents of, and physically located within, the 50 U.S. states or the District of Columbia (“Territory”). Employees of the Sponsor and its parent, subsidiary or affiliated companies; the advertising, promotional, fulfillment and service agencies of each of them; those others involved in the development, production or implementation of this Sweepstakes and any other persons or entities directly associated with this Sweepstakes (individually and collectively, “Entities”) and members of their households and immediate families are all ineligible to participate in this Sweepstakes. Neither the Entities nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, “Releasees”) are responsible for: (1) Entries from persons residing, or physically located, outside the Territory; (2) Entries that are altered, corrupted, delayed, deleted, destroyed, forged, fraudulent, garbled, illegible, improperly accessed, inaccurate, incomplete, interrupted, irregular in any way, late, lost, mechanically duplicated, misdirected, multiple, mutilated, postage-due, stolen, tampered with, unauthorized, undelivered, unintelligible or otherwise not in compliance with these Rules; (3) lost, interrupted or unavailable network, server or other connections; (4) miscommunications; (5) failed phone, computer hardware or software or telephone transmissions; (6) technical failures; (7) unauthorized human intervention; (8) traffic congestion; (9) garbled or jumbled transmissions; (10) undeliverable emails resulting from any form of active or passive email filtering; (11) insufficient space in your email account to receive email; or (12) other errors of any kind, whether due to electronic, human, mechanical, printing, production or technical errors or other causes; even if any of the foregoing is caused by the negligence of any of the Releasees. Each of the Entries described in the foregoing clauses (1) and (2) will be disqualified and any attempt by a person to use multiple accounts to enter more than once will result in disqualification. Void where prohibited or restricted by law and subject to all applicable federal, state, local and municipal laws and regulations.

4. PRIZES: 3 winners will receive the Collectible Bundle shown in post.

           Prizes are not redeemable for cash or other consideration and are not transferable. No substitution is allowed, except a prize of equal value may be substituted at the Sponsor’s sole discretion.  Sponsor will not replace any lost or stolen prize.

5. PROCEDURES: Sweepstakes will be conducted only during the Entry Period. Winners will be selected at random from all entries immediately following the end of the sweepstakes.

6. WINNERS: Each potential winner will be notified by direct message on Instagram. Winners will be selected at random from participants commenting during the entry period. At the sole discretion of the Sponsor, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: (1) potential winner’s failure to respond to the notification within 1 week of  the date that the notification is sent; (2) the return of the potential winner’s prize as undeliverable; (3) potential winner’s failure to validly claim his or her prize within ten (10) days after it is sent; (4) potential winner’s failure to provide Sponsor with satisfactory proof of age, identity and residency; (5) potential winner’s failure to execute and return an Affidavit of Eligibility/Liability/Publicity Release within seven business days after it is mailed; and (6) any other non-compliance with Rules. In the event of a prize forfeiture, the Sponsor may, in its sole discretion, award or not award the forfeited prize to an alternate winner. Each winner is solely responsible for any and all applicable taxes, as well as any fees/incidentals not included in the prize; and, if applicable, the winner will receive an IRS Form 1099 reflecting the value of his or her prize.

8. PRIVACY POLICY/DATA COLLECTION: All personal information provided by you for this Sweepstakes is subject to Sponsor’s privacy policy located at  https://www.fye.com/about/privacy-policy.html.

9. CONDITIONS: By entering this Sweepstakes and/or accepting any prize you may win, you agree that: (1) you will be bound by the Rules and the Sponsor’s decisions, which shall be final in all respects; (2) the Entry becomes solely the Sponsor’s property and will not be acknowledged or returned; (3) you release, indemnify and hold harmless the Releasees from any and all liability for claims, injuries, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize; participation in the Sweepstakes or any Sweepstakes-related activity or travel or from any interaction with, or downloading of, electronic Sweepstakes information; (4) the Releasees do not make any representation, warranty or guarantee, express or implied, relating to the Sweepstakes or the prizes; (5) winner’s acceptance of any prize constitutes the grant to Sponsor and its assigns of an unconditional right to use winner’s name, address (city and state only), voice, likeness, photograph, biographical and prize information, statements about the Sweepstakes and/or live and taped performances of interviews for any programming, publicity, advertising and promotional purposes without additional compensation, except where prohibited by law; (6) in the event viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsor’s reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of the Sweepstakes, so that it cannot be conducted as originally planned, except where prohibited by law, Sponsor has the right, in its sole discretion, to modify the Rules or to cancel, modify, terminate or suspend the Sweepstakes; and in such event, to select winners by such method as Sponsor in its sole discretion shall consider equitable; (7) the Releasees are not responsible for typographical or other errors in the offer or administration of this Sweepstakes, including but not limited to: errors in the advertising, Rules, selection and announcement of the winners and distribution of the prizes; (8) any portion of any prize not accepted or used by any winner will be forfeited; (9) the Releasees are not responsible for any inability of any winner to accept or use any prize (or any portion thereof) for any reason; (10) the Sponsor has the right, at any time and at its sole discretion, to disqualify any individual it suspects to be doing any of the following: (a) tampering or attempting to tamper with the Entry process or the operation of the Sweepstakes; (b) violating the Rules; (c) violating the terms of service, privacy policy or other terms, conditions of use and/or general rules or guidelines of any Sweepstakes property or service; (d) acting in bad faith, unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or (e) for any other good cause as determined solely by the Sponsor; (11) since any attempt by any individual to deliberately undermine the legitimate operation of the Sweepstakes is a violation of these Rules as well as criminal and civil laws, and should Sponsor believe or become aware that such an attempt has been, is being, or will be made, it has the right to seek remedies and damages from any responsible individuals to the fullest extent permitted by law, including without limitation, criminal prosecution; (12) all disputes, claims and causes of action at law or in equity (individually, a “Claim”) arising out of or relating to this Sweepstakes, the meaning or interpretation of the Rules or any prize awarded shall be resolved by applying the laws of New York, without regard to conflict of laws provisions therein, and shall be solely and exclusively brought in the state or federal courts within that state; (13) any Claim shall be resolved individually, without resort to any form of class action; (14) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event shall include attorneys’ fees, and under no circumstances will any entrant be permitted to obtain awards for, and he/she hereby waives all rights to claim, punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and all rights to have damages multiplied or otherwise increased; (15) Sponsor has the right to modify prize award procedures at its sole discretion; and (16) without limiting the generality of the foregoing, entrants agree that Releasees: (A) maintain no control over any personnel, equipment or operation of any air, water or surface carrier, bus or limousine company, transportation company, hotel, manufacturer or other person or entity furnishing services, products or accommodations (“Suppliers”) as a part of the prizes provided in connection with the Sweepstakes; and (B) will not be responsible or liable for any injury, damage, loss, expense, accident, delay, inconvenience or other irregularity that may be caused by or contributed to: (1) the wrongful, negligent or unauthorized act or omission on the part of any Suppliers or any of their agents, servants, employees or independent contractors, (2) any defect in or failure of any vehicle, equipment, instrumentality, service or product that is owned, operated, furnished or otherwise used by any of those Suppliers, (3) the wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of the Releasees, and (4) any cause, condition or event whatsoever beyond the control of the Releasees. By entering the Sweepstakes, you hereby represent and warrant that you have read these Rules and are fully familiar with its contents. 

10. MISCELLANEOUS:  The names of individuals, groups, companies, products and services mentioned herein, and any corresponding likenesses, logos and images thereof reproduced herein, have been used for identification purposes only and may be the copyrighted properties and trademarks of their respective owners. The mention of any individual, group or company, or the inclusion of a product or service as a prize, does not imply any association with or endorsement by such individual, group or company or the manufacturer or distributor of such product or service and, except as otherwise indicated no association or endorsement is intended or should be inferred. The invalidity or unenforceability of any provision of these Rules or any required documents pursuant to these Rules (e.g., Affidavit of Eligibility/Liability/Publicity Release, etc.) will not affect the validity or enforceability of any other provision. In the event that any provision of the Rules or any required document is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. For entrants, to the extent there is a conflict between these Rules and any of Sponsor’s rules or terms posted on its website, these Rules control.
